State v. Enterprise Co., 728 S.W.2d 812 (Tex.App.-Hous. [14 Dist.] 1986) caused the State of Texas to alter its practice of offsetting alleged benefits to remainders against value of parts taken (in partial taking condemnation cases) and paying landowners smaller amounts (less than market value) for their properties.

 

Harris County Flood Control Dist. v. Glenbrook Patiohome Owners Ass'n, 933 S.W.2d 570 (Tex.App.-Houston [1 Dist.] 1996) established that the right to collect maintenance fees is a valuable property right for which compensation must be paid (in condemnation cases).

 

City Of Houston v. O'Fiel, 2009 WL 214350 (Tex.App.-Houston [1 Dist.] 2009) Rev. Den. - established that a claim that a city ordinance constituted an  unconstitutional regulatory taking is ripe for adjudication though the owner made no application for permit if the ordinance left no discretion to the city or any of its agencies to issue such permits and provided for no exceptions or variances.
